Welcome to Casa Maly. The terms “we,” “us,” and “our” refer to Casa Maly LLC. Casa Maly operates this website and online store, including the information, content, features, tools, products, and services offered through it (collectively, the “Services”). Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.
These Terms of Service (“Terms”) describe your rights and responsibilities when accessing or using our Services. By visiting our website, placing an order, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have authorized a minor dependent to use the Services under your supervision.
You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.
SECTION 2 — PRODUCTS AND PRODUCT INFORMATION
We make every reasonable effort to display and describe our products accurately. However, colors and appearance may vary depending on your screen, device settings, lighting, and photography.
Many Casa Maly garments and accessories are handcrafted or produced using artisanal techniques. Small variations in measurements, length, width, weave, texture, finish, color, or placement of details may occur from one piece to another. These natural variations are part of the character of the product and are not considered manufacturing defects.
Measurements and sizing information are approximate and are provided as a general guide. Customers are responsible for reviewing the product description, measurements, materials, and care instructions before purchasing.
Product descriptions, prices, availability, and quantities may be changed at any time without notice. We reserve the right to discontinue products or limit sales by customer, household, geographic area, or jurisdiction.
SECTION 3 — ORDERS
Submitting an order constitutes an offer to purchase. An order is accepted only after payment has been authorized and Casa Maly sends confirmation that the order has been accepted.
We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, payment issues, resale activity, or product unavailability. If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.
Please review your order carefully before submitting it. Once an order has entered processing, we may be unable to change or cancel it.
Products purchased through Casa Maly are intended for personal or household use and may not be purchased for unauthorized commercial resale or export.
SECTION 4 — PRICES, PAYMENTS, AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of obvious errors.
Unless expressly stated otherwise, product prices do not include shipping, taxes, customs duties, import fees, or other charges that may apply. Applicable amounts will be displayed during checkout when available.
You agree to provide accurate and complete billing and payment information and confirm that you are authorized to use the selected payment method. We may use third-party payment providers to process transactions.
Promotions may be subject to separate conditions. If promotional conditions conflict with these Terms, the specific promotional conditions will apply to that promotion.
SECTION 5 — SHIPPING AND DELIVERY
Order processing and delivery times are estimates and are not guaranteed. Delays may occur due to carriers, customs, severe weather, high order volume, promotional periods, or other circumstances outside our reasonable control.
International customers are responsible for applicable customs duties, taxes, import fees, and other charges imposed by the destination country. Casa Maly is not responsible for customs charges or for the time an order remains in customs.

SECTION 6 — RETURNS, EXCHANGES, AND FINAL-SALE ITEMS
Returns, exchanges, store credits, product-condition requirements, return shipping costs, non-refundable shipping charges, and final-sale items are governed by our Return and Refund Policy, which forms part of these Terms.
Nothing in these Terms or our policies limits any consumer right that cannot legally be waived in the customer’s jurisdiction.
SECTION 7 — ERRORS, INACCURACIES, AND AVAILABILITY
Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, or delivery estimates.
We reserve the right to correct errors, update information, or cancel affected orders. If an order is canceled after payment has been processed, we will refund the applicable amount.
SECTION 8 — PERSONAL AND PERMITTED USE
The Services and their content are provided for lawful, personal, and non-commercial use.
You may not use the Services:

All content available through the Services—including the Casa Maly name and logo, trademarks, text, photographs, product images, graphics, videos, designs, and website arrangement—is owned by or licensed to Casa Maly LLC and is protected by applicable intellectual-property laws.
No content may be copied, reproduced, distributed, modified, published, displayed, sold, licensed, or commercially used without prior written permission from Casa Maly LLC or the applicable rights holder.
Shopify’s names, logos, products, and services are trademarks of Shopify. Other names and trademarks appearing through the Services belong to their respective owners.
SECTION 10 — REVIEWS, COMMENTS, AND FEEDBACK
If you voluntarily submit a review, photograph, comment, suggestion, or other content (“Feedback”), you confirm that you have the right to provide it and that it does not violate any law or third-party right.
You grant Casa Maly a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, edit, and share that Feedback for operating, improving, and promoting the Services.
We may remove Feedback that is unlawful, misleading, offensive, infringing, fraudulent, or otherwise inappropriate. You remain responsible for the accuracy and legality of the content you submit.
SECTION 11 — THIRD-PARTY SERVICES AND LINKS
The Services may include tools, payment services, applications, content, or links provided by third parties. We do not control and are not responsible for third-party websites, services, policies, accuracy, availability, or security.
Your use of third-party services is subject to the applicable third party’s own terms and policies. Questions or claims relating to a third-party product or service should be directed to that provider.
SECTION 12 — RELATIONSHIP WITH SHOPIFY
Casa Maly’s store is hosted by Shopify, which provides the technology used to offer the Services. Purchases made through this store are transactions directly between you and Casa Maly LLC.
Shopify is not the seller of Casa Maly products and is not responsible for fulfilling orders, handling returns, or resolving claims relating to products purchased from Casa Maly, except to the extent Shopify separately provides a service directly to you.
SECTION 13 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy, which forms part of these Terms.
Because Shopify hosts our store, certain personal information is also processed by Shopify and by service providers that assist with payments, shipping, analytics, fraud prevention, customer support, and other store operations.
SECTION 14 — DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services and products offered through them are provided “as is” and “as available,” except for any express commitments stated in our published policies or required by law.
We do not guarantee that access to the Services will always be uninterrupted, timely, secure, or error-free. We do not exclude or disclaim any warranty or consumer protection that cannot legally be excluded.
SECTION 15 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Casa Maly LLC and its owners, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Services or products purchased through them.
This limitation does not apply where liability cannot legally be limited or excluded. Nothing in these Terms limits liability for fraud, willful misconduct, or any other liability that applicable law does not permit us to exclude.
SECTION 16 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Casa Maly LLC and its affiliates, employees, agents, contractors, licensors, and service providers from third-party claims, losses, or reasonable expenses arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.

We may suspend or terminate your access to the Services if you violate these Terms, misuse the Services, or engage in conduct that could harm Casa Maly, Shopify, another customer, or a third party.
Provisions that by their nature should continue after termination—including intellectual property, disclaimers, limitations of liability, indemnification, and governing law—will remain in effect.
SECTION 18 — SEVERABILITY AND WAIVER
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted, and the remaining provisions will remain effective.
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
SECTION 19 — ENTIRE AGREEMENT AND ASSIGNMENT
These Terms, together with the policies referenced in them and any additional terms presented at the time of purchase, constitute the entire agreement relating to your use of the Services.
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a reorganization, merger, sale, or transfer of our business, subject to applicable law.

These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of Georgia and applicable federal laws of the United States, without regard to conflict-of-law principles.
Any dispute that is not otherwise resolved will be submitted to a court of competent jurisdiction in the State of Georgia, except where applicable consumer law gives you the right to bring a claim in another jurisdiction.
